Terms of Service for HVAC Touch Clients

1. Acceptance of Terms

By accessing or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access our website or use our services.

HVAC Touch reserves the right to modify these Terms at any time. Your continued use of our services following any changes constitutes acceptance of the revised Terms.

2. Description of Services

HVAC Touch provides commercial HVAC services including but not limited to:

• HVAC system installation, repair, and maintenance for commercial buildings
• Condo building HVAC services including fan coil units, PTAC units, and heat pumps
• Commercial refrigeration services
• Emergency HVAC services (24/7 availability)
• Preventive maintenance programs and service contracts
• HVAC energy audits and system optimization
• Ventilation system installation and repair

Services are provided throughout the Greater Toronto Area, including Toronto, Mississauga, Brampton, Markham, Vaughan, Richmond Hill, Oakville, Etobicoke, Scarborough, and North York.

3. Quotes and Estimates

We provide free quotes and estimates for most services. Quotes provided are valid for 30 days from the date of issuance, unless otherwise specified.

Final pricing may vary from estimates based on actual conditions discovered during service delivery. Any significant changes will be communicated to you for approval before proceeding.

4. Payments and Billing

Payment Terms

• Payment is due upon completion of service unless otherwise agreed in writing
• For large projects, a deposit may be required with progress payments as specified in the contract
• We accept payment methods including credit cards, debit cards, electronic bank transfers, and business cheques

Late Payments

Late payments may be subject to interest charges of 1.5% per month (18% per annum) on the outstanding balance. Service may be suspended for accounts with overdue payments.

5. Cancellations and Rescheduling

Appointments may be cancelled or rescheduled without charge if notice is provided at least 24 hours before the scheduled appointment time.

Cancellations with less than 24 hours' notice may be subject to a trip charge or cancellation fee. Emergency service appointments cancelled after dispatch will be charged the minimum emergency service fee.

6. Client Responsibilities

As a client, you agree to:

• Provide safe and reasonable access to equipment and work areas
• Ensure the work area is clear of obstacles and hazards
• Provide accurate information about equipment, symptoms, and service history
• Obtain any necessary property management approvals or permits (for condo buildings)
• Supervise pets and restrict access to work areas during service visits
• Pay all invoices on time according to agreed payment terms

7. Warranty and Guarantees

Labour Warranty

We warrant our workmanship for a period of 90 days from the date of service. This warranty covers defects in workmanship but does not cover damage caused by misuse, neglect, or unauthorized modifications.

Parts and Equipment

Replacement parts and equipment are covered by the manufacturer's warranty. Warranty terms vary by manufacturer and product. We will assist you in processing manufacturer warranty claims where applicable.

Warranty Exclusions

Warranty does not cover: damage from improper maintenance, power surges, environmental factors, cosmetic damage, or equipment not installed by HVAC Touch.

8. Limitation of Liability

To the fullest extent permitted by law, HVAC Touch shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of use, loss of business, or loss of revenue
• Property damage beyond our control (acts of God, power failures, etc.)
• Damages exceeding the amount paid for the specific service in question

Our total liability to you for any claim related to our services shall not exceed the amount you paid for the service giving rise to the claim.

9. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of HVAC Touch or its licensors and is protected by Canadian copyright laws.

You may not reproduce, modify, distribute, or create derivative works from any website content without our express written permission. Unauthorized use may constitute violation of copyright and trademark laws.

10. Indemnification

You agree to indemnify and hold harmless HVAC Touch, its employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of our website or services
• Your violation of these Terms
• Your violation of any third-party rights
• Any breach of your representations and warranties

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

We encourage you to contact us directly to resolve any disputes informally before pursuing legal action.

12. Termination

We reserve the right to suspend or terminate services if:

• You violate these Terms
• You fail to pay for services rendered
• Providing services creates safety concerns or violates applicable laws
• Access to your property is repeatedly denied or restricted

13. Modifications to Terms

HVAC Touch reserves the right to modify these Terms at any time. We will notify you of material changes by posting the revised Terms on our website and updating the "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the revised Terms.
